Bangalore Temple Wins Court Case !
Karnataka High Court dismisses appeal of ISKCON Mumbai followers

Honourable High Court of Karnataka dismissed an appeal filed by some of the followers of ISKCON Mumbai on April 9th, 2015. Honourable Justice Anand Byrareddy was hearing an appeal filed by followers of ISKCON Mumbai seeking to get control of ISKCON Bangalore Society (Regn. No. S.49/78-79), claiming that they are the actual Governing body members. Earlier the same application was filed in the City Civil Court as OS 1758 of 2003 in Bangalore by ISKCON Mumbai followers and had been dismissed.

This is the ongoing dispute between ISKCON Bangalore and ISKCON Mumbai with Sri Madhu Pandit Dasa’s official reply to EC, followed by the EC Letter to Madhu Pandit Dasa. Hopefully all this will be settleded up someday, and devotees can go back to serving the mission of Srila Prabhupada and Lord Caitanya, and work together again in the spirit of cooperation.

Dear Tamohara prabhu, Anuttama prabhu, and Praghosa prabhu,

Please accept my humble obeisances. All glories to Srila Prabhupada.

We beg to acknowledge your letter dated 27th Oct 2013 addressed to three of us. I had immediately replied to your above letter on 28th October stating that we will respond to it soon. I noticed several discrepancies vis-a-vis what transpired in the meeting as you have stated. There were many things in the your letter which did not represent accurately and completely what transpired in our discussion in Chennai with HH Jayapataka Swami, HH Bhanu Swami and Dayaram Das. Probably it is due to miscommunication and partial communication from the source where you got the information (from one of the bureau members). It is understandable considering that it is second hand information and those who presented it also probably wanted to dilute it hoping against hope for some serious reforms in ISKCON and was shooting off our shoulders to achieve the same.

July 9th Letter

Some of our readers may or my not be familiar with the famous July 9th Letter; which was Srila Prabhupada’s final instruction on initiation. This is also the main point of contention in the Battle over ISKCON Bangalore. ISKCON Bangalore’s position is that Srila Prabhupada is the Founder-Acarya of ISKCON, and will continue to give diksha (initition) through the process of Rittik initiation, and guide all devotees in ISKCON to the abode of Lord Sri Krishna. Whereas ISKCON Mumbai’s position is that since Srila Prabhupada is no longer physically present, one should take diksa (initiation) from one of the present ISKCON gurus.

I applaud the devotees of ISKCON Bangalore in their Struggle for Truth, and their courageous stand for honesty and justice.

News update on the Battle over ISKCON Bangalore. Very sad to see so much time and energy is being wasted in trying to stop a successful preaching mission, that is promoting Srila Prabhupada and the Sankirtan Mission of Lord Caitanya Mahaprabhu.

ISKCON Bangalore to continue management of the temple on Hare Krishna Hill.

For transparency a committee headed by Justice Raveendran will oversee and advice the management of the temple ISKCON Bangalore and ISKCON Mumbai have been litigating for the past twelve years about who owns the famous ISKCON temple on Hare Krishna Hill in Rajajinagar, Bangalore.

The Supreme Court bench consisting of Justice Altamus Kabir and Justice Cyriac Joseph had given a status quo order on July 5th 2011 allowing the plaintiff society (ISKCON Bangalore) to continue management of the affairs of the temple till further orders.

In response to this, ISKCON Mumbai filed an Interim Application appealing to vacate the status quo order and to permit a Supervisory Committee of ISKCON Mumbai to supervise the affairs of ISKCON Bangalore temple. The Supreme Court bench consisting of Justice Altamus Kabir, Justice Surendra Singh Nijjar and Justice J Chalameswar heard this interim application on Dec 14th, 2011 and declined to vacate the status quo order and disallowed the Supervisory Committee of ISKCON Mumbai. The bench confirmed that ISKCON Bangalore shall continue to oversee the affairs of the temple on Hare Krishna Hill.  And for the sake of transparency and to oversee and advice the management of the temple, the bench ordered formation of a committee headed by the retired Supreme Court judge, Justice Raveendran. The committee will also consist of one representative from ISKCON Bangalore (Stoka Krishna Das) and one representative from ISKCON Mumbai (Ananda Tirtha Das).

The bench also ordered that the case should be heard for final disposal on February 16th, 2012.

“We welcome this order of the Supreme Court and extend full support to the Committee,” said Madhu Pandit Das, President, ISKCON Bangalore.

Press Note

We are willing to settle and handover the control of ISKCON Bangalore society registered in 1978 if the above ISKCON Law (ISKCON Law 6.4.7.2) is rescinded and it is openly declared that Srila Prabhupada is the only Acharya of ISKCON and that no one else should accept disciples within ISKCON. Any further discussions on the peace proposal can be worked out provided these facts are first accepted by ISKCON Mumbai. Only based on this first step can any peace or settling of issues can make meaningful progress.

ISKCON Mumbai is not serious about peace

We got to know through media sources that ISKCON Mumbai’s Bureau members conducted a press conference today and claimed that they are willing to settle the dispute between ISKCON Bangalore and Mumbai as per the Supreme Courts’ desire. We are sending this clarificatory press release so as to present the actual facts of the matter.

We wish to place on record that ISKCON Bangalore was the first to offer a peace proposal, we had offered peace proposal as early as 4th of February 2009. This peace proposal was given just before City Civil Court pronounced its verdict that ISKCON Bangalore registered in 1978 is an independent society and that ISKCON Mumbai registered in 1971 should not interfere with Bangalore’s affairs. This proposal was categorically rejected by ISKCON Mumbai. From the time, His Divine Grace A.C.Bhaktivedanta Swami Prabhupada, reverentially addressed as Srila Prabhupada, founded ISKCON in New York in 1966, ISKCON grew into a large, transnational organization spanning many countries, having 108 centers and more than 10,000 members, in a matter of 10 years. This was due to the immense spiritual stature and vision of our Founder Acharya, Srila Prabhupada.

While the growth of the organization was impressive, in 1977, just prior to Srila Prabhupada’s leaving this world, it was a young organization and most of the members and devotees, mainly westerners, had not developed the required spiritual stature, knowledge, realization, immense purity and gravity that is required to occupy the post of his spiritual successor, as an “Acharya”.

High Court restrains ISKCON Mumbai / ISKCON Bangalore
May 24th 2011 Bangalore. 

The divisional bench of the High court of Karnataka today restrained ISKCON Mumbai from dislodging or removing Sri Madhu Pandit Dasa as President, other office bearers and employees of ISKCON Bangalore for 6 weeks. The High Court further observed that there are various yeoman services being rendered from the institution to the society and abrupt changes in the management, missionaries, employees and other members would disrupt the same leading to far reaching consequences.

The High Court also observed that other activities, organizations or trusts which are functioning from the Hare Krishna Hill premises are not part of this suit and hence their activities should go on unhindered.

The divisional bench of the High Court was giving their decision on the stay petition filed by ISKCON Bangalore. It may be recalled that the High court had set aside the verdict given by the Trail Court of Bangalore which had given absolute ownership of Sri Radha Krishna-chandra temple on Hare Krishna Hill to ISKCON Bangalore Society registered in 1978.
The counsel for ISKCON Bangalore said that the stay petition is not about the verdict and hence should be considered on the following grounds:

1. ISKCON Bangalore has been in de-facto possession of the Hare Krishna Hill premises for the last several decades and various court orders were in its support.

2. The practicality of any transfer of management will not be possible on an immediate basis.

3. ISKCON Bangalore has already given an undertaking in the Supreme Court that it will not alienate or part with the assets, and are willing to submit to any process of reporting to the court.

After hearing the  objections of ISKCON Mumbai to this stay petition, the High Court bench consisting of Justice Nagmohan Das and Justice Arali Nagaraj gave their restraining order that ISKCON Mumbai shall not invoke their constitutional powers to dislodge Madhu Pandit Das, other current functionaries, missionary devotees and employees of ISKCON Bangalore serving in the temple from their services. The court also stated that Akshaya Patra and other trusts which are functioning from Hare Krishna Hill where ISKCON temple has been built are not party to the case and should function on their own. This order shall facilitate the smooth functioning of the various activities of ISKCON Bangalore and at the same time enable ISKCON Bangalore to file an appeal in the Supreme Court.

“ISKCON Bangalore will file an appeal in the Supreme Court shortly after obtaining and studying the order copy. We have full faith in the judiciary of our country and are confident that we will be able to present the case in our favor,” said Madhu Pandit Das, President of ISKCON Bangalore.
